You acknowledge that any use of the Website including any transactions you make is subject to our terms and conditions (referred to as "Terms and conditions"). Please: (1) read through these Terms and conditions carefully before using the Website, (2) print a copy for future reference, (3) also read our Privacy policy section regarding your personal information.

We reserve the right to change these Terms and conditions at any time. Any change will take effect when posted on the Website. Please read the Terms and conditions at each opportunity you use the Website.

If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use the Website.

The information on the Website is in English, all communications will be in English and contract will be formed in English.

If you have a complaint about the Website, the Product or other, please contact us. We constantly strive to solve potential disputes with our customers on our own. In case of a dispute you may use an alternative consumer dispute resolution by a consumer arbitration body.

If any provision of these Terms and Conditions are determined to be invalid, unlawful or unenforceable the remainder of these Terms and Conditions shall continue to be valid and enforceable.

3. SERVICE AVAILABILITY

We accept orders for delivery in the UK and the EU, but different shipping charges apply for delivery to EU countries and to the UK.

4. REGISTRATION

Certain services on the Website will require registration and subsequent access to those services will be subject to an approved login and password.

Information that you provide on the Website must be accurate and complete.

You agree to be responsible for maintaining the confidentiality of your password or other information’s about the account and all activities under your account.

You may terminate your account at any time. We may terminate your registered account when we believe that you have not complied with these Terms and conditions or law regulations.

5. PRODUCTS ON THE WEBSITE

On the Website we offer jewellery (referred to as "Product"). The Products are new, not used. You may order Products made to yours specifications or personalized – the right of cancellation does not apply for such Products in accordance with section 9

By advertising the Products on the Website we are inviting you to place an order.

The images of the Products on the Website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your device display of the colours accurately reflects the colour of the Products. That’s why Products may vary slightly from those images.

We try to get on the Website Product descriptions, pricing and specifications right, but specifications may change and we reserve the right to withdraw or substitute items if necessary.

6. ORDER PROCESS

By placing an order on the Website, you warranty that you are legally capable of entering into binding contracts and that you are at least 18 years old.

When you place an order whether by telephone (+44 77 136 810 76) or via the internet by Website, together with appropriate payment and payment method it constitutes an offer to us to buy a Product. Such an offer is subject to our acceptance. We will not accept your order until we have checked the availability of stock in our warehouse. In the ordering proces at any time you may check and amend information before submitting the order.

If you place an order you will receive an e-mail from us acknowledging that we have received your order, on which we will give you full details of the order, such as: order No, information about the Products, prices, delivery cost, your shipping address and other. Please note that this does not mean that your order has been accepted.

Our acceptance of your order will take place when we will send to you an e-mail with the confirmation that the Products have been dispatched (referred to as „Dispatch Confirmation”).

The contract (referred to as „Contract”) between us will only be formed when we send you the Dispatch Confirmation.

If we are unable to supply the Product, we will inform you of this by e-mail and we will not process that part of your order which deals with such a Product. If you have already paid for the Product, we will refund you the full amount including any delivery costs charged. In the case of an order with multiple Products we will refund only that element of the order which relates to the price of such Product and we will not refund the delivery costs. Each order made will be charged separately. If only part of your order is available, we will only dispatch the Products that are in stock, and cancel the out of stock Products.

7. PRICE AND PAYMENT

The price of Products on the Website is quoted in GBP and EURO.

Prices for Products may change from time to time, but changes will not affect any order you have already placed.

The price does not include delivery charges, which will be added to the total amount due. Our delivery charges are as advised to you during the check-out process, before you confirm your order.

The price does not include duty and other tax relating to the delivery of Products to the EU from the UK. You are obliged to pay such taxes. Please note that you must comply with any applicable laws
and regulations of the country for which the Products are destinated. We will not be liable for any breach by you of such laws.

We accept payment via PayPal, PayPal Visa (credit/debit card) and Maestro MasterCard.

The payment for the Products and all applicable delivery charges has to happen in advance within 3 hours after placing an order. The lack of payment within that timeframe will automatically cancel the order. We must receive the payment for the Products and any delivery charges in full, before dispatching the Products to you.

Ownership of the Product will pass to you when we will receive the full amount of the payment for the Product.

8. DELIVERY

The estimated delivery time is based on the selected deliver method.

FREE SHIPPING our standard delivery service you will normally receive within 2-4 working days . We deliver Monday to Saturday between the hours of 8 am – 5 pm Orders are made to fit through all standard size UK letter boxes.

NEXT DAY DELIVERY, Royal Mail Special Delivery Guaranteed – offers time delivery by 1pm next day with inclusive tracking and CUSTOMER SIGNATURE ON DELIVERY .

Available ONLY for orders placed and paid for before 10 noon (Monday to Friday). All orders will be dispatched the same working day .

We make every effort to deliver goods within the estimated delivery time, however delays are occasionally inevitable due to unforeseen factors.

Ordered Products will be delivered to you by Royal Mail. We will send Products to you within 2 days after the date of the Contract. If we miss the delivery deadline for any Products then you may cancel your order. However if you will not cancel the order you can give us a new deadline for the delivery, which must be reasonable, and you can cancel your order if we do not meet the new deadline.

The Product will be at your risk from the time of delivery.

9. CONSUMER RIGHT TO CANCEL THE ORDER

We hope you love your purchase from Zolya, however if you change your mind ,we will refund the value of any of any item as long it is returned, unopened, unused.

The consumer has the right to cancel the Contract (subject to certain exceptions set out below). We give you 28 days to cancel the Contract without giving any reason. The cancellation period is counted from the day of delivery of the Products of your order.

If you would like to cancel the order you need to inform us about it, for example you may use the form attached to the Terms and Conditions. You may do this by post: 9 The Green NG34 8LH Leasingham Sleaford or by email: shop@zolya.co.uk.

You must return the Products to us at your own risk and cost within 14 days of notifying us that you wish to cancel the Contract by sending them to: 9 The Green NG34 8LH Leasingham Sleaford.

You are responsible to take reasonable care of the Product.

Right of cancellation does not apply to the sell of Products that are made to the consumer’s specifications , are clearly personalized or earrings.

Earrings are non-returnable due to health and safety reasons.

After cancelling the Contract, we will reimburse you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us).

We will make the reimbursement without undue delay, and not later than 14 days from the day when we receive the Product from you or we receive the proof of shipment (whichever is the shortest). We will use the same means of payment that you used for the purchase, unless you have expressly agreed otherwise. You will not incur any fees as a result of such reimbursement.

You are only liable for any diminished value of the Product resulting from their handling, other than that which is necessary to establish the nature, characteristics and functioning of the Product.

10. STATUTORY RIGHTS

Nothing in these Terms and conditions excludes or limits your legal rights.

Our Products aim to comply with your legal rights to be of satisfactory quality, to be fit for purpose, and to match their description.

You may return or exchange the Product if the Product is not of satisfactory quality, if it does not fit for its purpose or if it is not the same as described on the Website.

You have 28 days from the delivery date to raise a complaint and get full refund for the Products and delivery costs. After this deadline we can offer you in first priority to repair or exchange. You have 6 months from the date of buying a Product to request a repair or an exchange. If those solutions are not possible or not effective, you may request a refund or a discount if you want to keep the Product. After 6 months you need to prove that the Product was having a defect and usually you are not anymore liable for the costs related to the refund, unless the Product was really having a defect.

If you decide to return the Product to us, please send it to: 9 The Green NG34 8LH Leasingham Sleaford.

We will inspect the Products and either replace them or refund the full purchase price of the Products if we accept that there is a manufacturing defect or other fault in the Products. We will cover all the delivery costs related to the return of the Product by you.

11. INTELLECTUAL PROPERTY

You acknowledge and agree that:

- all copyright, trademarks and all other intellectual property rights in all materials and content on the Website shall remain at all times vested in us or our licensors;

- material and content on the Website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website;

- any other use of the material and content of the Website is prohibited and you agree not to copy, reproduce, transmit, publish, display, distribute such material and content.

12. LAW AND JURISDICTION

These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England. The parties irrevocably agree that the courts of England shall have non-exclusive jurisdiction to settle any such dispute or claim.
